What data is processed, and from which sources does this data originate?
Create Success Consulting GL e.U. processes personal data provided or collected within the scope of the customer relationship. Personal data includes, in particular, your personal information (e.g., name, address, electronic contact details, date of birth), data received or created during consultation (contracts, goal agreements, protocols, resumes, photos), data related to purchased services, and data provided during payment.
For what purposes and on what legal basis is the data processed?
Create Success Consulting GL e.U. processes your personal data in accordance with the provisions of the European General Data Protection Regulation (EU) 2016/679 (GDPR) and Austrian data protection law:
- To fulfill contractual obligations (Art. 6(1)(b) GDPR): The processing of personal data (Art. 4(2) GDPR) is carried out to fulfill contractual obligations arising from the consulting/coaching contract.
- To fulfill legal obligations (Art. 6(1)(c) GDPR): Processing of personal data may occur to fulfill various legal obligations (e.g., tax-relevant data).
- With your consent (Art. 6(1)(a) GDPR): If you have granted consent for the processing of your personal data, processing will only take place in accordance with the purposes and scope defined in the consent statement. Consent can be revoked at any time with future effect.
- To protect legitimate interests (Art. 6(1)(f) GDPR): To the extent necessary, data processing may go beyond the fulfillment of the contract in order to protect legitimate interests of Create Success Consulting GL e.U. or third parties.
Data processing for the following purposes is based on the protection of legitimate interests:
- Measures to protect customers
- Measures to protect company property
- Conducting legal proceedings
Who receives my data?
Data processors appointed by Create Success Consulting GL e.U. (especially IT service providers) and contractual partners (e.g., insurance companies) receive data necessary for the fulfillment of their respective services. All data processors are contractually obligated to treat your data confidentially and process it exclusively within the scope of service provision.
In case of a legal obligation, public authorities and institutions may be recipients of your personal data.
How long will my data be stored?
Create Success Consulting GL e.U. processes your personal data, as necessary, for the entire duration of the contractual relationship (from initiation, execution to termination of the contract) and beyond in accordance with legal retention and documentation obligations, which include, among others, the General Civil Code (ABGB) and the Federal Fiscal Code (BAO).
Additionally, statutory limitation periods, which can generally be 3 years or, in certain cases, up to 30 years under the General Civil Code (ABGB), must be considered in the storage duration.
What data protection rights do I have?
You have the right to information, correction, deletion, or restriction of the processing of your stored data, the right to object to processing, and the right to data portability under the conditions of data protection law. Complaints can be addressed to the Austrian Data Protection Authority at https://www.dsb.gv.at/.
